Terms of Service
These Terms govern your use of the service, including account rules, AI processing, billing, credits, and intellectual property protections.
Important: This document includes acceptable-use rules, billing terms, and copyright/takedown procedures.
1. Agreement to Terms
These Terms of Service are entered into between you and Cramblr (referred to as “we”, “us”, or “our”) and govern your use of Cramblr and related websites and services (collectively, the Service).
By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility and Account Responsibility
- You must be legally able to form a binding contract in your jurisdiction.
- You must provide accurate account information and keep it up to date.
- You are responsible for all activity occurring under your account, including safeguarding your login credentials.
2.1 Google Sign-In
You may register or log in using Google OAuth (“Continue with Google”) instead of email and password. By using Google sign-in, you also agree to Google’s applicable terms and privacy policy for that authentication step.
- New Google sign-ups are subject to these Terms and our Privacy Policy, including terms acceptance recorded at account creation.
- If an account with the same email address already exists, we may link your Google sign-in to that account so you can access it with either method.
- You are responsible for maintaining control of your Google account and any activity performed after Google authenticates you to the Service.
- We may disable Google sign-in at any time; you are responsible for maintaining another way to access your account if email/password login is unavailable.
3. Service Description
The Service is a study tool that allows users to upload study materials, process those materials with AI services, create and review flashcards, study with spaced repetition, and export decks.
The Service is provided for personal study and learning support only. It does not provide professional tutoring, academic accreditation, exam guarantees, or regulated educational advice. Features may change, be added, or removed over time.
4. User Content, Rights, and Permissions
- You retain ownership of content you upload, including images, text, decks, and exports.
- You grant us a limited, non-exclusive license to host, process, reproduce, and transmit your content solely to operate and provide the Service to you.
- You represent and warrant that you have all rights and permissions needed to upload and process your content, including copyright and privacy permissions where required.
5. AI Processing and Output
- The Service may send your inputs (including uploaded images and text) to third-party AI providers to perform extraction, generation, and speech synthesis.
- AI-generated content may be inaccurate, incomplete, or unsuitable for your specific use. You are responsible for reviewing all output before relying on it for study or any other purpose.
- You must not use AI output from the Service for unlawful, deceptive, or rights-infringing purposes.
6. Credits, Subscriptions, and Billing
The Service tracks a credit balance in your account. One credit is used for each page you process through the Service. Paid features, where enabled, are processed by Stripe, Inc. and its affiliates.
6.1 Subscriptions
You may subscribe to a monthly plan that adds credits to your balance when you subscribe and on each billing cycle. Subscriptions renew automatically until cancelled. You may cancel at any time through your account billing settings or the Stripe billing portal. Cancellation stops future charges; it does not retroactively refund amounts already paid.
6.2 Payment terms
By purchasing, you agree to:
- Pay all fees, taxes, and charges shown at checkout.
- Authorize recurring charges for subscription plans until cancellation.
- Provide and maintain valid payment information.
We do not store full payment card numbers. Stripe processes payment details under its own terms and privacy policy.
6.3 Refunds
Except where required by applicable law, all payments are final. Used credits are not refundable. We may, at our sole discretion, restore credits for processing failures attributable to the Service. For duplicate or erroneous charges, contact us promptly at [email protected].
7. Acceptable Use and Prohibited Conduct
You may not misuse the Service, including by:
- Uploading malware, abusive content, or unlawful content.
- Uploading material you do not have the right to use, including copyrighted textbook content you are not permitted to reproduce.
- Attempting unauthorized access to other accounts, systems, or data.
- Circumventing rate limits, security controls, or access restrictions.
- Using automated scraping, reverse engineering, or attacks that degrade service reliability.
8. Intellectual Property and Copyright Claims
The Service software, branding, and platform content are owned by us or our licensors and are protected by law.
- If you believe content on the Service infringes your rights, submit a notice to [email protected] with sufficient detail to identify the content and your claim.
- We may remove or disable access to allegedly infringing material while reviewing a claim.
- We may suspend or terminate accounts that repeatedly infringe intellectual property rights.
9. Suspension and Termination
We may suspend or terminate access if you violate these Terms, create legal or security risk, or misuse the Service.
You may stop using the Service at any time and may delete your account from your profile settings. Certain provisions survive termination, including sections on payments due, intellectual property, disclaimers, limitation of liability, indemnity, and general provisions.
10. Disclaimers
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy of AI output, and uninterrupted availability.
We do not guarantee study outcomes, grades, exam results, or the suitability of generated flashcards for any particular curriculum or institution.
11. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business interruption arising from or related to the Service.
Our aggregate liability for claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the event giving rise to liability, or (b) £100.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or any other liability that mandatory consumer protection laws do not allow to be limited.
12. Indemnification
You agree to defend, indemnify, and hold harmless us and our affiliates, officers, and employees from claims, losses, damages, and reasonable expenses (including legal fees) arising out of your content, your use of the Service, or your breach of these Terms.
13. Changes to Terms
We may update these Terms from time to time. Material changes will be posted with an updated effective date. Continued use after the effective date of revised Terms means you accept the updated Terms.
14. General Provisions
- Entire agreement: These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Service.
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
- Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights in connection with a merger, acquisition, or sale of assets.
- Governing law: These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. Courts in that jurisdiction have exclusive jurisdiction over disputes arising from these Terms, except where mandatory consumer protection laws require otherwise.
